Introduction to the Terms of Use

Article 1 – Introduction and Definitions

The above preamble forms an integral part of this Agreement. The following definitions apply to the key terms used throughout this Agreement:

1. Store

The term "Store" refers to all forms of the Store operating online, including but not limited to a mobile application, a website on the Internet, or a physical retail outlet.

2. Customer

The term "Customer" refers to any person who engages in e-commerce for the purpose of obtaining the products or services offered by the Store through its electronic platform.

3. Agreement

The term "Agreement" refers to these Terms and Conditions, which govern and regulate the relationship between the parties to this Agreement.

Article 2 – Customer Legal Capacity

1. The Customer acknowledges that they have the legal capacity, in accordance with the applicable laws and regulations, to enter into transactions with the Store, or that they are at least eighteen (18) years of age.

2. The Customer agrees that, in the event of any violation of this Article, they shall bear full responsibility for the consequences of such violation toward any third party.

Article 3 – Nature of the Store’s Obligation

1. The Store's obligation toward its Customers is to provide the products and/or services offered through the Store.

2. The Store may also provide additional services, such as after-sales support or other related services, depending on the nature and type of the product and/or service requested by the Customer.

Article 4 – Rules of Use

1. The Customer agrees to use the Store's electronic platform in compliance with public morals and all applicable laws and regulations of the Kingdom of Saudi Arabia.

2. When purchasing any product or service from the Store, the Customer agrees not to use such product or service in any manner that violates public morals or the applicable laws and regulations of the Kingdom of Saudi Arabia.

Article 5 – Accounts and Registration Obligations

Upon applying to register as a user of the Store, you are required to provide certain information and create a username and a confidential password to access the Store's services. By registering, you agree to the following:

1. You are responsible for maintaining the confidentiality of your account information and password. You agree to notify the Store immediately of any unauthorized use of your account or password, or of any other breach of your account security.

2. Under no circumstances shall the Store be liable for any direct or indirect loss or damage, whether material or moral, resulting from the disclosure of your username, password, or account credentials.

3. You agree to use your Store account or membership personally. You are solely responsible for all activities conducted through your account. Any use of your account by another person shall be deemed to have been authorized by you and carried out on your behalf.

4. You agree to use the Store responsibly, honestly, and in good faith.

5. You agree to provide accurate, truthful, current, complete, and lawful information about yourself during the registration process and to update such information whenever necessary to ensure it remains accurate and up to date.

6. The Store is committed to treating your personal information and contact details with the utmost confidentiality.

7. If the Store determines that you have provided false, inaccurate, outdated, incomplete, unlawful, or misleading information, or information that violates these Terms of Use, the Store reserves the right to suspend, freeze, or terminate your membership and account without prejudice to any other legal rights or remedies available to the Store to protect its interests and those of other customers.

8. If you fail to comply with any of the above obligations, the Store reserves the right to suspend or terminate your account or membership and to deny you access to the Store's services at its sole discretion.

Article 6 – Electronic Communications and Official Contact Methods

1. The parties to this Agreement agree that all communications shall be conducted through the email address or telephone number registered on the Store's platform.

2. The Customer acknowledges and agrees that all agreements, notices, disclosures, and other communications provided electronically shall have the same legal effect as written communications and shall constitute valid and sufficient evidence for all legal and regulatory purposes.

3. The Customer agrees that the Store may contact and notify them regarding matters related to this Agreement or their transactions by sending general announcements to all Customers or targeted communications to specific users of the Store.

Article 7 – Amendments to the Terms of Use and Fees

1. If any provision or clause of this Agreement is canceled, declared invalid, or becomes unenforceable, such cancellation or invalidity shall not affect the validity or enforceability of the remaining provisions, terms, rules, and conditions of this Agreement, which shall remain in full force and effect until otherwise determined by the Store.

2. This Agreement, as amended from time to time when necessary, constitutes the basis for the relationship, understanding, and agreement between the Customer and the Store.

3. The Store may charge fees to certain Customers depending on promotional offers, products, services requested, or any government-imposed fees, taxes, or charges applicable to the products or services.

4. The Store reserves the right to add, increase, reduce, waive, or modify any fees or charges in accordance with the provisions of these Terms of Use, regardless of the reason for the Customer's registration.

Article 8 – Payment Services

1. The Store, through its payment partners, provides payment processing services. Payments may be made entirely online using the payment methods available on the Store or through any additional payment methods introduced by the Store from time to time.

2. The Store undertakes to set the prices of the products and services offered in accordance with the prevailing market value.

3. The Store undertakes to issue invoices, payment receipts, and transaction records for all payments and revenues generated through the Store and shall provide the Customer with an invoice for every product or service purchased.

4. The Store undertakes to maintain generally accepted accounting standards and practices within its online store in accordance with the provisions of this Agreement and in support of legal, commercial, financial, and regulatory requirements.

Article 9 – Intellectual Property

1. All intellectual property rights relating to the Store are the exclusive property of the Store, whether such rights existed prior to or were created after the establishment of this electronic platform.

2. The Customer agrees to respect the Store's intellectual property rights, including but not limited to the Store's name, trademarks, logos, trade names, symbols, designs, and any other proprietary content displayed on or associated with the Store. All such rights are fully owned by the Store and are protected under applicable intellectual property laws.

Article 10 – Store Responsibilities

1. The Store undertakes to conduct its business through this electronic platform in accordance with the applicable laws and regulations of the Kingdom of Saudi Arabia and the provisions of this Agreement.

2. The Store shall not be liable for any claims, losses, or damages arising from errors or negligence, whether direct, indirect, incidental, or resulting from the Customer or any third party, including shipping companies.

3. The Store, its employees, owners, and authorized representatives undertake to ensure that the products and/or services offered are lawful, authorized, and compliant with the laws and regulations of the Kingdom of Saudi Arabia, and are intended for lawful purposes only.

Article 11 – Restriction of Access or Membership

The Store reserves the right to suspend, terminate, or restrict a Customer's membership or access to the platform's services at any time, without prior notice, for any reason and at its sole discretion.

Article 12 – Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and shall be subject exclusively to the applicable laws and the competent authorities of the Kingdom of Saudi Arabia.

Article 13 – General Provisions

If any provision or clause of these Terms of Use is canceled, declared invalid, or becomes unenforceable, such invalidity shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect until otherwise determined by the Store.

These Terms of Use, as amended from time to time, constitute the entire agreement governing the relationship, understanding, and contractual arrangements between the Store and the Customer. Both parties further agree to the following:

1. The Arabic language shall be the governing language for the interpretation of these Terms of Use. In the event of any discrepancy between the Arabic version and any translated version, the Arabic version shall prevail.

2. All prices displayed for the Store's products and services are subject to change from time to time without prior notice.

3. Any promotional or marketing offers made by the Store are temporary. The Store reserves the right to amend, suspend, or discontinue such offers at any time.

4. Both parties agree to conduct all dealings in compliance with the Islamic principles, applicable laws, and regulations of the Kingdom of Saudi Arabia governing the relationship between the Store and the Customer.

5. These Terms of Use may only be terminated or revoked by a decision issued by the Store's management.
